Grievance Procedure
Policy
Review and investigate all written grievances regarding ISM Staff and members of the Shura.
Objectives
1. The Grievance Committee (“Committee”) will only address grievances that are in writing and signed and dated by the person making the grievance (hereinafter referred to as the “Complainant”).
2. All written grievances regarding ISM Staff and members of the Shura (hereinafter referred to as the “Target”) will be reviewed and investigated in a timely manner.
3. Each grievance/complaint will be documented and appropriate action taken in a timely manner.
4. All written grievances will be considered in light of appropriate Islamic behaviors and norms.
5. The Committee will consist of two members of the Shura, one Trustee, the Imam, the Religious Director and the Executive Director. If one or more of these individuals is/are the target(s) of the grievance, then this/these person(s) shall be excluded from the Committee and substituted with Shura members
Procedure
1. Any grievance shall be submitted in writing to the Executive Director who will review it to assure that the necessary information is included. If the Executive Director is the target of the grievance, the grievance shall be submitted to the Religious Director (the “Substitute”).
2. The grievance shall contain detailed information about the nature of the grievance, the names of witnesses (if any) and any other documentation that would support the grievance.
3. The grievance can be emailed, hand delivered or sent by certified mail to the Executive Director or the Substitute. If sent by email, and the Executive Director (or the Substitute) does not acknowledge its receipt within 48 hours of being sent, the Complainant shall assume that the grievance was not received and the Complainant shall then hand deliver or mail (by certified mail) the grievance to the Islamic Society of Milwaukee, 4707 S. 13th Street, Milwaukee, WI 53221.
4. The Executive Director will submit copies of the written grievance (along with documents and other evidence that has been provided by Complainant) to the Grievance Committee members. A copy of all items shall also be sent to the President of the Board (unless the President is the target of the Grievance).
5. The Grievance Committee will consult with one another to decide upon a course of action. If the grievance involves a serious matter (involving a violation of the laws of the State of Wisconsin), the matter will be referred to the proper authorities. In all other cases, if the Grievance Committee believes that the grievance has merit, the Grievance Committee shall forward a copy of the grievance (along with supporting documents) to the Target.
6. Before any action is taken or decision is made about any grievance, the Target must be provided with an opportunity to provide a written response to the grievance. The Target shall also have a right to request the opportunity to confront and question her/his accuser before the Grievance Committee.
7. Followed its complete investigation, the Grievance Committee shall issue and convey its findings to the Complainant and the Target.
8. The grievance committee shall keep detailed notes of all proceedings (without identifying the position of any particular Committee member). All information will be kept confidential..
Timeframe
Upon receiving a
written grievance the Executive Director (or the Substitute) will review
it, gather pertinent information and submit all information to the
Grievance Committee within 5 days of receipt of the grievance.
The Grievance Committee will
review the grievance, consult on the investigative approach and evaluate
the issue. The Target shall be provided with a period of not less than
seven days to response to the grievance. The Committee will attempt to
issue its findings within thirty days
The Executive Director will send a written response to the Complainant and Target within 5 days from receiving a response from the Grievance Committee.
